Extension of Stay in Ukraine

There are situations when a foreigner needs to stay in Ukraine beyond the allowed number of days on a visa-free stay or longer than specified in the visa. In such cases, foreigners can avail themselves of the service of extension of stay in Ukraine. This procedure allows them to continue staying in Ukraine legally and avoid administrative penalties in the form of fines and potential entry bans.

Grounds for extension of stay in Ukraine

Let’s consider the list of grounds for extending the period of stay provided for by Resolution of the Cabinet of Ministers No. 150 of February 15, 2012.

  • medical treatment;
  • childbirth;
  • caring for a sick family member (including a pregnant);
  • forced stay in Ukraine due to extraordinary circumstances;
  • inheritance procedures;
  • eligibility for permanent or temporary residence permit;
  • application for immigration permit;
  • application for Ukrainian citizenship;
  • other circumstances preventing the foreigner’s departure.

It’s worth noting that the list of grounds is not exhaustive, and the migration service may also consider other justifications. Therefore, for each specific situation, we recommend consulting with us for guidance.

What is required for the extension of stay in Ukraine?

  • Documents confirming the grounds for extension.
  • Presence of a host. This can be a legal entity/citizen of Ukraine/foreigner with a permanent residence permit in Ukraine.
  • Availability of housing for residence. The property owner with ownership documents must be present during document submission.
  • Financial support. It is confirmed by the actual presence of the legally required amount of money or a written guarantee from the hosting party.

Timeline

Applicants must contact the migration service no later than 3 working days before the end of the established period of stay in Ukraine. However, there are exceptions when documents can be submitted later.

Document processing time: 3 working days.

Duration of the extended stay: up to 6 months, depending on the grounds. If the foreigner has reasons to extend the stay after this period, they can reapply to the migration service.

As a result of document review, the foreigner’s passport will be stamped with the approved duration of stay in Ukraine.

Important! If a foreigner leaves Ukraine, the stamp for the extended stay is annulled. To re-enter Ukraine, they will need to obtain a visa or wait until “free” days for visa-free stay become available.

If you need qualified assistance in document preparation and support during your visit to the migration service, please contact us. The lawyers of Residence Law Firm will be happy to help.
