Residence Permit Based on Employment for Students in Ukraine

Advantages of a Residence Permit Based on Employment for Students in Ukraine

One of the key advantages of obtaining a work-based residence permit for students is that the foreigner does not need to leave the country to apply for a new type D visa. In 2022, the Ukrainian government introduced changes to the Laws of Ukraine “On Employment of the Population” and “On the Legal Status of Foreigners and Stateless Persons” which allow students to exchange their residence permit from study-based grounds to employment-based grounds, provided they find employment no later than 30 days before the end of their studies. This simplification is particularly beneficial for citizens of African and Asian countries, who often face difficulties obtaining visas to Ukraine.

How to Obtain a Residence Permit Based on Employment for Students in Ukraine

The process of switching from a study-based residence permit to an employment-based one has specific nuances compared to the regular procedure for obtaining a temporary residence permit. Therefore, it is recommended to trust this process to a lawyer.

1. Obtaining a Work Permit

A work permit is the key document required to obtain a residence permit. To apply for the work permit, a Ukrainian employer is necessary, as they submit the application on behalf of the foreigner. Students also need to submit documents from their university confirming the facts and dates of their studies. The work permit is granted for up to one year and can be extended.

2. Employment

The employment status is confirmed by a signed employment contract and a notification from the tax service about the individual being hired. It is important to employ the foreigner within 90 days from the date of issuance of the work permit and notify the employment center within 10 days; otherwise, the work permit will be canceled. For students, there is an additional condition: they must be employed no later than 30 days before the end of their studies.

3. Exchange of the Residence Permit for Temporary Residence

Documents for exchanging the residence permit must be submitted to the local office of the State Migration Service. The application must be submitted no later than 15 working days before the legal stay in Ukraine expires. We will prepare all the necessary documents and assist you during the submission process. 4. Registration of Residence

After obtaining the new residence permit, it is essential to update the residence registration certificate. Foreign students are usually registered at university dormitories, and this registration expires after graduation. Therefore, it is recommended to arrange a different registration address in advance. Failure to register for 30 or more days will result in a fine.
