In the era of innovation and intense competition, it is crucial to ensure differentiation and recognition for your business. One of the key steps in this direction is trademark registration in Ukraine. In Ukraine, as well as in other countries, this is a necessary procedure to ensure the protection and effective use of your business brand.
A trademark is a sign by which the goods and services of one party are distinguished from those of others.
Who needs the service of trademark registration?
The service of trademark registration in Ukraine will be beneficial for any entrepreneur or company aiming to identify their goods or services in the Ukrainian market and protect them from unauthorized use by competitors. It allows the creation of a unique image and enhances consumer trust. Trademark registration is also mandatory if you want to register a “.ua” domain.
In Ukraine, trademarks can be registered in the form of the following designations or their combinations:
- Words (names, letters, numbers);
- Images;
- Colors and their combinations;
- Shape of goods or their packaging;
- Sounds.
An example of a sound trademark is the well-known McDonald’s jingle: “I’m lovin’ it.”
How does the trademark registration process work?
- First step: Consultation, where we gather initial information about the future trademark and explain the procedure, official fee amounts, and registration timelines.
- Second step: We search open registers to check whether your future trademark conflicts with already registered trademarks.
- Third step: Selection of classes of goods and services for which your trademark will be registered, completion of the application, and submission of documents to the Ukrainian National Intellectual Property Office (Ukrainian abbreviation: UANIPIO). After registering the application with UANIPIO, you can also initiate the process of international trademark registration.
- Fourth step: Examination of the trademark by UANIPIO. The usual duration is 18-22 months, during which the intellectual property office checks your trademark for compliance with legal requirements and similarity with other trademarks.
- Fifth step: Issuance of a trademark registration certificate valid for 10 years. The date of filing the application is considered the start date of your trademark’s protection.
